1. Introduction and Nature of Service

• Welcome to the website. These Terms and Conditions constitute a legally binding agreement between you (hereinafter: "the Client") and the business of Ariella Chagag, registered in Czechia under the Business Identification Number (IČO: 23185040) at the address: Malešická 2855/2, Praha, 130 00 (hereinafter: "the Business"), for the booking of food tours in Prague.

• All content displayed on this website, including but not limited to photos, texts, logos, designs, and tour itineraries, is the exclusive intellectual property of the Business. No part of this content may be copied, reproduced, or distributed without prior written consent.

2. Cancellation and Modifications Policy (Cancellation Policy)

Cancellation by the Client:

We value transparency and want everything to be simple and clear upfront. The cancellation terms for the tour are as follows:

• Cancellation 7 days or more in advance: If you cancel your booking 7 days (or more) before the scheduled day of the tour, you will be entitled to a full refund of the total amount paid.

• Cancellation between 7 days and 24 hours in advance: In the event of a cancellation within this timeframe, the deposit paid at the time of booking is non-refundable and will be retained as a cancellation fee.

• Cancellation less than 24 hours in advance: If you cancel your tour less than 24 hours before its scheduled time, or in the case of a no-show, the booking will be subject to a full charge of the total tour cost, and no refund or credit will be provided.

• Legal Note: In accordance with Section 1837(j) of the Czech Civil Code and EU consumer protection directives, as this transaction concerns leisure and hospitality services booked for a specific date, the automatic 14-day right of withdrawal does not apply.

Fees, Processing, and Exchange Rate Fluctuations on Refunds:

• Any refund issued to the Client will be sent exactly in the amount and currency originally received by the Business.

• The Business bears no responsibility for, and will not compensate for, differences resulting from currency exchange rate fluctuations, conversion fees, or processing fees charged by the Client's banks, credit card companies, or payment processors during the refund process.

 

Cancellation by the Business and Minimum Participant Requirement:

• Cancellation due to urgent circumstances: In exceptional and unforeseen circumstances (such as illness of the guide or force majeure) where the Business must cancel the tour, you will be notified as early as possible, and all monies paid will be refunded in full immediately.

• Minimum Participants: Due to budgeting constraints and agreements with our partner venues, tours require a minimum of 3 participants to run. In the rare event that this minimum is not met, we will contact you by the morning of the tour day to offer an alternative date or issue a full refund.

• Limitation of Liability: It is explicitly clarified that in any case of cancellation by the Business, liability is strictly limited to the refund of the tour cost paid. The Business shall not be held liable for any incidental or consequential expenses incurred by the Client (such as flights, hotel bookings, etc.).

Confirmation and Agreement to Terms:

• Making a payment for the deposit and/or the full tour price constitutes explicit confirmation that the Client has read, understood, and fully agreed to these Terms and Conditions and Cancellation Policy.

 

3. Website Content Disclaimer (Disclaimer)

• Accuracy of Information: The contents, recommendations, and information published on this website (including routes, opening hours of local venues, and pricing) are provided on an "As-Is" basis. While the Business makes every effort to keep information accurate and updated, it does not guarantee that the content will be completely free of errors, omissions, or sudden changes made by third-party vendors in Prague.

• Limitation of Liability for Damages: The Business, its owner, or anyone acting on its behalf shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from reliance on the information provided on this website, or from temporary website unavailability due to technical issues.

 

4. Allergies, Dietary Restrictions, and Supplier Liability

• Requirement to Contact and Confirm in Advance: In cases of food allergies or medical dietary restrictions, the Client is strictly required to contact us via email prior to making a booking to receive formal written confirmation regarding whether the tour can accommodate them.

• Exclusion from Group Tours: Due to the group nature of the activity and full reliance on external kitchens and third-party vendors, individuals with food allergies cannot participate in the regular group tours. It is the Client's responsibility to contact us in advance to explore the possibility of arranging a safe, customized, and private tour (subject to vendor availability in Prague).

• Cross-Contamination Disclaimer: The food tastings are provided by independent restaurants, stalls, and local vendors in Prague that are subject to EU food regulations. However, since these kitchens are not owned or controlled by the Business, we cannot guarantee absolute sterility against cross-contamination of allergens or other ingredients in the vendor's workspace. Liability for food preparation and service rests solely with the hosting establishment.

 

5. Tour Conditions, Weather, and Insurance

• Prague Weather Conditions: Tours operate in all weather conditions (including rain, snow, or cold). It is the responsibility of the participants to dress appropriately. No refunds will be issued for non-attendance due to weather conditions, provided the tour takes place as scheduled.

• Travel Insurance Requirement: The Business does not provide medical or third-party liability insurance. Participants are strictly required to secure valid international travel insurance. The Business shall not be held liable for any personal injuries, illnesses, or loss of personal property occurring in public spaces or inside vendor venues during the tour.

 

6. Updates and Modifications to Terms

• The Business reserves the exclusive right to update, change, or modify these Terms and Conditions at any time. The binding version of the terms is the most current version published on the website at any given moment. Continued use of the website or booking tours after changes are published constitutes agreement to the updated terms.

 

7. Termination of Service

• The Business may, at its sole discretion and without prior notice, restrict or completely block access to the website (or parts of it) for users who violate these Terms and Conditions, or for technical maintenance purposes.

 

8. Privacy Policy and Data Protection (GDPR Compliance)

• Data Collection and Processing: When booking a tour, the user provides personal data (full name, email address, phone number, and payment details) in accordance with the EU General Data Protection Regulation (GDPR). The Business uses this data strictly for processing the booking, coordinating the Prague meeting point, and providing customer service. Payment details are securely processed and encrypted by authorized third-party payment gateways and are not stored on our website's servers.

• User Rights: Under the GDPR, users have the right at any time to request access to the personal data stored about them, to correct it, or to request its complete erasure ("the right to be forgotten"), provided the data is not legally required for tax and accounting reporting purposes in the Czech Republic.

 

9. Governing Law and Jurisdiction

• The Business is operated and managed in the Czech Republic by Ariella Chagag. These Terms and Conditions, their interpretation, and any disputes arising from them shall be governed exclusively by the laws of the Czech Republic and the European Union.

The exclusive venue for any legal proceedings or disputes shall be the competent courts in Prague, Czech Republic.
